Website Project Agreement

Payment of Fees.

Fees to BITWC.COM design and hosting services are due and payable on the following schedule: $500 down when project starts. The remaining amount is due upon signing the completion of the contract. This only applies to the basic package. Once the initial website is up the and this includes the mock ups the down payment is no longer refundable. You do have 72 hours from the date of the signing to request a full refund. If the website has not been started and you want a refund after the 72 hours, there is a 20% charge against the $500.00 down payment for my services.

Assignment of Project

BITWC.COM design and hosting services reserves the right to assign subcontractors to this project to insure the right fit for the job as well as on-time completion

Maintenance and Hourly Rate

This agreement includes minor webpage maintenance to regular webpages and NOT storefronts. Other than mispelled words fees will apply unless an agreement between both parties are agreed upon.  If the client or an agent other than BITWC.COM design and hosting services attempts updating the client's pages, time to repair webpages will be assessed at the hourly rate, and is not included as part of the updating time.

Changes requested by the client beyond those limits will be billed at the hourly rate of $55.00.

If an legal issue arise due on the client side there will be billable charges a rate of $55.00 an hour to cover BITWC time and services.. BITWC  will comply with all documentation from any legal source until otherwise proven wrong.

Clent requesting transfer of his site

A client my have his website and all files transfered providing all charges are up todate. BITWC  will not cover any fees required by a new hosting services nor will there be a refund from BITWC after 30 days of services.  If payments to BITWC are not up to date the follow process takes place before the site can be transfered.

Non-Payment issue.:

• You have 15 days to pay these new charges for the removal of the images.
• If it is not paid within 15 days the website will be into a suspension mode for 15 days
• I will then take the site completely off line for 15 more days until payment is received, after this 15 days (total of 45 days) the site and all content will be completely remove from servers. (deleted) if payment is not received. Which means it cannot be replaced.

Web Hosting

The client understands that the web hosting services require a separate contract with a web hosting service. The website will be hosted on BITWC.COM hosting services. The client agrees that BITWC.COM will have full access to the website and a cgi-bin directory via FTP and telnet. The client further understands that if the web hosting service's operating system is not a Unix system, standard CGI software may not work, and providing a substitute may incur additional charges.

Completion Date

BITWC.COM design and hosting services and the client must work together to complete the website in a timely manner. We agree to work expeditiously to complete the website within the time line on the agreement. THIS IS PROVIDING CLIENT HAS CONTENT AND IMAGES READY

If the client does not supply BITWC.COM design and hosting services complete text and graphics content all webpages contracted for within six weeks of the date this contract was signed, the entire amount of the contract becomes due and payable. If the client has not submitted complete text and graphics content within two months after signing of this contract, an additional continuation fee of 10% of the total contract price will also be assessed each month until the website is advertised.

Laws Affecting Electronic Commerce

From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend BITWC.COM design and hosting services and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.

Copyright to Webpages

Copyright to the finished assembled work of webpages produced by BITWC.COM design and hosting services is owned by BITWC.COM design and hosting services. Upon final payment of this contract, the client is assigned rights to use as a website the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. BITWC.COM design and hosting services and its subcontractors retain the right to display graphics and other Web design elements as examples of their work in their respective portfolios.
